TERMS OF SERVICE AND ONLINE SALES REGULATIONS
Effective from: 08.10.2025
§ 1. Definitions
Seller – Tomasz Zawisza, conducting business under the name P.P.U.H. TechMobil Tomasz Zawisza, registered at Siedliska Sławęcińskie 57, 38-242 Skołyszyn, NIP (Tax ID): 685-187-90-53, e-mail: techmobil@techmobil.pl, phone: +48 698 999 111.
Customer – a natural person, legal person, or organizational unit without legal personality who makes a purchase in the Store.
Consumer – a Customer who is a natural person making a legal transaction not directly related to their business or professional activity.
Store – online services operated by the Seller at the following addresses:
www.techmobil.pl, www.canfix.tech, www.kianav.pl, www.hyundainav.pl, www.navcarcode.com.
Product – a tangible good (e.g., diagnostic device) or digital content (e.g., software) available in the Store’s offer.
Service – a service provided by the Seller, such as car navigation repair.
§ 2. General Provisions
These Terms of Service define the rules for using the Store, placing orders for Products and Services, concluding sales agreements, and handling complaints.
To browse the Store and place orders, the Customer must have a device with Internet access, a standard web browser, and an active e-mail account.
§ 3. Orders and Fulfillment
Orders can be placed via the order form available on the Store’s website or by e-mail.
Submitting an order requires acceptance of these Terms of Service.
To place an order, the Customer must provide data necessary for its fulfillment.
After receiving an order, the Seller promptly confirms its receipt, which constitutes the conclusion of the sales contract.
Prices listed in the Store are gross prices (including VAT) and are expressed in Polish zlotys (PLN), unless stated otherwise.
The Seller reserves the right to change Product prices, introduce new Products, and conduct or cancel promotional campaigns.
§ 4. Payments and Delivery
Available payment methods are specified during the ordering process (e.g., traditional bank transfer, online payments).
Delivery of physical Products is carried out via courier services to the address provided by the Customer. Shipping costs are displayed during the ordering process.
Delivery of digital Products (e.g., software) is made by providing a download link or sending files to the specified e-mail address.
§ 5. Right of Withdrawal (for Consumers)
A Consumer has the right to withdraw from a distance contract without giving any reason within 14 days from the date of taking possession of the Product.
To exercise the right of withdrawal, the Consumer must inform the Seller of their decision by means of a clear statement (e.g., by letter sent by post or e-mail).
In the event of withdrawal from the contract, the Seller shall reimburse the Consumer for all payments received, without delay and no later than 14 days from the date of receiving the withdrawal notice.
Note: The right of withdrawal does not apply to contracts for the supply of digital content (e.g., software) not delivered on a tangible medium if performance has begun with the Consumer’s prior express consent before the withdrawal period has expired and after being informed by the Seller about the loss of the right of withdrawal.
§ 6. Complaints
The Seller is obliged to deliver Products and Services free from defects.
If a defect is found in the Product, the Customer has the right to file a complaint under the provisions of the Civil Code (warranty for defects) or under the warranty terms, if provided.
Complaints should be submitted by e-mail to: techmobil@techmobil.pl.
A complaint should include at least: the Customer’s name, description of the defect, and the Customer’s request.
The Seller will respond to the complaint within 14 days of its receipt.
§ 7. Personal Data Protection
The principles of processing Customers’ personal data are set out in the Privacy Policy, available on the Store’s websites.
§ 8. Final Provisions
In matters not regulated in these Terms of Service, the applicable provisions of Polish law shall apply.
The Seller reserves the right to amend these Terms of Service. The amended Terms are binding on the Customer if they have been notified of the changes and have not terminated the agreement within 14 days.
The court competent to resolve disputes with Customers who are not Consumers shall be the court having jurisdiction over the Seller’s registered office.
